Terms of Service

The short version: Be respectful, post authentic content, own what you share, and don't abuse the community. We reserve the right to remove content or accounts that violate these terms.

1. Acceptance of Terms

By accessing or using Poticas.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site. These Terms constitute a legally binding agreement between you and Poticas.com, operated by Zengine™ and owned by Vincent Gonzalez ("we," "us," "our").

2. Description of Service

Poticas.com is a community platform dedicated to potica — the traditional Central European rolled pastry. The Site allows registered users to share recipes, stories, and experiences; interact with other community members; and receive notifications about our upcoming shop.

To access certain features (including posting to the community feed), you must create an account. You agree to:

4. User Content

4a. Your Content, Your Responsibility

You retain ownership of any content you post to the Site ("User Content"), including recipes, stories, photos, and comments. By posting User Content, you grant Poticas.com a non-exclusive, royalty-free, worldwide, transferable license to use, display, reproduce, distribute, and modify your User Content in connection with operating and promoting the Site.

We reserve the right, but not the obligation, to review, monitor, remove, or edit User Content at our sole discretion, at any time, without notice. Removal of content does not constitute an admission of liability or wrongdoing on our part.

The Site and its original content (excluding User Content), features, functionality, design, and branding — including the Poticas.com name, spiral logo, and overall aesthetic — are owned by Poticas.com and Zengine™ and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary content without express written permission.

7. Advertising

The Site displays advertisements served by Google AdSense (publisher ID: ca-pub-8826956454892311). We do not control the content of these advertisements. Clicking on advertisements may direct you to third-party websites. We are not responsible for the content or practices of advertised third-party sites.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Recipes and food preparation information provided on the Site are for informational purposes only. We make no representations about the accuracy, completeness, or suitability of any recipe for any purpose, including dietary needs or allergies. Always exercise appropriate caution when preparing food.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POTICAS.COM AND ZENGINE™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR USER CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED $100.

10. Indemnification

You agree to defend, indemnify, and hold harmless Poticas.com, Zengine™, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Site, your User Content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the Site at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, indemnification, and limitation of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Lee County, Florida.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date above. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
